Probate is the legal process of transferring title to property. Whether a person dies testate (with a properly executed Will) or intestate (without a Will), all property owned in their individual name is subject to probate. Probate may be informal or formal, supervised or unsupervised. The Court appoints a personal representative of the Estate who is entrusted with duties and empowered to settle and distribute the estate as expeditiously and efficiently as is consistent with the best interests of the estate.
The Personal Representative must keep the heirs, devisees or interested persons apprised throughout the entire process. They are required to submit an inventory and publish a notice to creditors. They must also see that debts of the decedent are paid. There are many other duties and requirements of the Personal Representative, which leads many individuals feeling overwhelmed and in over their head. It is not uncommon for their to be surprises or issues, particularly where real property is involved.

If you have minor children: a judge will appoint a legal guardian to care for them and a conservator to manage any assets you leave behind until they reach age 18. When your children reach 18, all assets are handed over to them to manage individually.
